It
has been reported by the learned counsel Mr. Bhatt who is appearing
for accused that out of three accused against whom the State has
preferred acquittal appeal, Jaykorben Ishwarbhai Paneriya has expired
on 02.12.2009 and the Certificate is also produced. Under these
circumstances, appeal shall stand abated qua her.

It
was submitted by the learned counsel appearing for the accused that
the appeal be fixed at an earlier date. It appears that the paper
book is ready. Hence, the same be listed for hearing in the week
beginning on 17.01.2011.
