ORDER

1. RULE.

Shri Virat Popat, learned advocate waives service of notice of
rule on behalf of the respondents.

2. In
the facts and circumstances of the case and with the consent of the
learned advocates appearing on behalf of the respective parties, the
present application is taken up for final hearing today.

3. The
present application has been preferred by the applicant-State of
Gujarat for fixing the early date of hearing and/or vacating the
interim relief granted by this Court.

4. Considering
the fact that when earlier the interim relief was granted it was
after hearing the learned advocates appearing on behalf of the
respective parties, the prayer for vacating the interim
relief/ad-interim relief is not pressed. However, it is requested to
direct the Registry to place the main matter for final hearing at
the earliest.

5. Having
heard the learned advocates appearing on behalf of the respective
parties and considering the nature of controversy in the main matter,
Registry is directed to notify Criminal Miscellaneous Application No.
1097/2008 for final hearing in the week commencing from 20/12/2010.

6. With
this, the present application is allowed. Rule is made absolute to
the aforesaid extent.
