Petition for bail.
2. The alleged offences are under sections 8(2) and 55(a)
of the Abkari Act. According to prosecution, 400ml. of arrack
was seized from the house of petitioner on 16-10-2008 and she
was arrested from the spot.
3. Learned counsel for petitioner submitted that
petitioner is a woman and she is in custody for the past 12 days.
The quantity involved is only 400 ml. The house in which the
article was seized is not in the exclusive possession of petitioner
alone. Her husband and two adult children are residing there.
4. Learned Public Prosecutor submitted that no other
crime is registered against petitioner. Hence, he has no objection
in granting bail on conditions.
5. Hence, petitioner shall be released on bail on her
executing a bond for Rs.25,000/- with two solvent sureties each
for the like amount to the satisfaction of the learned Magistrate,
on the following conditions:-
1) Petitioner shall not commit any offence

while on bail and in case breach of this
condition, bail is liable to be cancelled.
This petition is allowed.
