2. 07.03.2011 Heard learned counsels for the

petitioners and the State.

The petitioners being the husband

and family members of the husband are

apprehending their arrest in complaint case

in which cognizance has been taken under

Section 498A of the I.P.C.

Learned counsels for the petitioners

and the complainant on instructions submit

that both the husband and wife are ready to

resume the conjugal life.

However, learned counsel for the

petitioners submits that in solemn

affirmation the complainant has stated that

she does not want to stay with the husband.

Considering the stand of the

parties, let the petitioners, Jagdish Singh,

Bindhawashni Devi, Subhash Singh @ Subhash

Chandra Singh, Chandra Shekhar Singh and

Subodh Singh @ Subodh Kumar Sinha be

released on bail in the event of arrest or

surrender before the learned court below

within a period of twelve weeks from today

in connection with complaint case no. 91C of

2009 on furnishing bail bond of Rs.10,000/-

(Ten Thousand)each with two sureties of the

like amount each to the satisfaction of the

learned C.J.M. Khagaria, subject to the

conditions as laid down under Section 438(2)

of the Code of Criminal Procedure.

The husband’s bail bond will be

provisionally accepted.

Let the husband and complainant

appear before the learned court below on

28.03.2011 when the complainant will

accompany the husband to her matrimonial

house.

The provisional bail bond of the

petitioner will be finally accepted in two

eventualities of substantial restoration of

matrimonial life or on refusal of the

complainant to accompany the husband.
