We have heard learned counsel for the petitioner, learned standing counsel
appearing for respondent no.1 and Shri M.C. Tripathi learned counsel

The petitioner has an adequate alternative remedy of filing an appeal before
Commissioner.

This petition is dismissed on the ground of alternative remedy of filing an
appeal.
