This is an application for recall of the order dated 24.10.2009
whereby this writ petition was dismissed for non prosecution. It is
supported with an affidavit.

Heard learned counsel for the petitioner as also for the
respondents. The reasons shown in the affidavit for non
appearance of learned counsel for the petitioner on 24.10.2009
when the matte was dismissed in default is sufficient. The order
dated 24.10.2009 is recalled. The application is allowed. The writ
petition is restored to its original number.
