02/ 04.02.2011 Heard learned counsel for the petitioner as well as learned

P.P. for the State.

Petitioner seeks his bail in connection with Pandarak P.S.

Case no.148/2007 registered under section 396 of the IPC.

Petitioner is not named in the first information report and

nothing has been recovered from his conscious possession. It appears

from perusal of the impugned order of the learned Addl. Sessions

Judge XI, Patna that name of this petitioner transpired in the

confessional statements of co- accused persons and admittedly,

several co-accused persons have already been granted privilege of bail

by different benches of this court.

In the aforesaid circumstances, petitioner, Sujay Singh @

Sujay Kumar is directed to be released on bail in connection with

Pandarak P.S. Case no. 148 of 2007 on furnishing bail bond of Rs

10,000/- with two sureties of the like amount each to the satisfaction

of Addl. Chief Judicial Magistrate, Barh.
