The stand of the State seems to be correct that

when the petitioner approached this Court earlier his case was

considered for all the benefits as is evident from annexue-2. At

that time no case for time bound promotion was raised. The

respondents have already granted the benefit of retiral dues. Now

as an after thought the present writ application has been filed after

his retirement which is in the opinion of the Court is barred by res

judicata. It is dismissed on that ground.
