Heard learned counsel for the applicant, learned A.G.A. for the State and perused
the record.
Learned counsel for the applicant has contended that there are cross cases and from
side of the applicant one person was murdered and one received injuries. The
applicant is in jail since 4.3.2010. Co-accused Hakim has been allowed bail by this
Court.
Learned A.G.A. has contended that 5 persons were murdered in this case and there
is allegation against the applicant showing his involvement in the murder.
There are cross cases. Both sides have sustained injuries and from side of the
applicant one person murdered.
Considering the nature of accusation and the severity of punishment in case of
conviction and the nature of supporting evidence, reasonable apprehension of
tampering of the witnesses and prima facie satisfaction of the court in support of the
charge, the applicant is entitled to be released on bail.
Let the applicant Sukkan Singh @ Saroj Singh @ Surjan Singh involved in
case crime no. 104 of 2010, under section 147, 148, 149, 364, 302, 201, 436, 307,
395, 427, 412 IPC, P.S. Parikshat Garh, District Meerut be released on bail on his
furnishing a personal bond with two sureties each in the like amount to the
satisfaction of the court concerned.
