Heard the parties.
Learned counsel appearing for the petitioner submits that
the petitioner’s husband-late Prakash Ram Asur, who was an
Assistant Teacher in Government Middle School, Ichha, Gumla, died
in harness on 4.4.2008 but neither the death-cum-retiral dues towards
provident fund, gratuity, Group Insurance, leave encashment, arrears
of salary etc. has been paid to her nor family pension has still been
fixed though the petitioner in this respect had made several
representation before the District Superintendent of Education, Gumla
– respondent no. 2, but nothing was done in this respect and,
therefore, no option was left with the petitioner but to move to this
Court for redressal of her grievance.
Since the claim is still to be decided by the Authority,
this writ application is disposed of directing the petitioner to file a
fresh representation, raising all her claims, which have been claimed
in this writ petition, before the District Superintendent of Education,
Gumla (respondent no. 2), along with a copy of this order, within three
weeks from today so that the respondent no. 2, on receiving such
representation, takes a decision in the matter relating to the payment
of death-cum-retiral dues to the petitioner within a period of eight
weeks thereafter.
On such determination, the amount, found payable to the
petitioner, must be paid to her immediately thereafter.
