On 3.7.2009, the following order was passed:-

“Learned counsel for the petitioners submits that in
the present case in cross fight both the parties had suffered
injuries. All the injuries on the person of both the sides were
found to be simple in nature. It is only one injury suffered by
Harmesh Singh on his right forearm with sharp edged
weapon which was found to be grievous in nature for which
Section 326 IPC was invoked.”

Learned counsel for the State submitted that on enquiry from the
village it was found that it was not a case of cross fight. He further stated that in an
accident of two motorcycles the petitioners also intervened and caused injuries to
the complainant side when the matter was being settled by the Sarpanch.

It is not disputed that the petitioners had already joined the
investigation. Be that as it may, without expressing any opinion on the merits of
the controversy, in my opinion, custodial interrogation of the petitioners is not
required. The interim bail granted to the petitioners vide order dated 3.7.2009 is
made absolute.

The petition stands disposed of.
