                      J U D G M E N T

1. Allegation is that the respondents have failed

to comply with the direction in Annexure-I Judgment, to

the extent that they have failed in considering waiver of

interest/penal interest and expenses. Further it is

alleged that, inspite of payment of Rs.75,000/- before

15.1.2010, as stipulated in the judgment the

respondents have failed to intimate the petitioner about

the net balance payable, after adjusting all payments

and after considering waiver as directed.

2. Counsel for respondents produced a copy of

the letter sent by the Bank to the petitioner, on

17.4.2010, in compliance with the direction. Through

the said statement the Bank had permitted the

petitioner to make payment of the balance amount in 4

equal monthly installments starting from 15.5.2010

onwards.

3. In view of the fact that a statement has already

been supplied and time for making payment of the balance

amount has been relaxed, I am of the view that the

respondents could not be held liable for any contempt,

eventhough there occurred some delay in issuing the

balance statement, due to which the petitioner has not been

put to any prejudice.

In the result the Contempt Case is hereby closed.
