11.08. 2009. Mr. A.K.Mehta, learned counsel for the respondent
Nilambar Pitamber University submits at the outset that considering the
demand of the petitioners for payment of arrears of salary, the respondent
University has assessed the payable amount and has forwarded
requisition on 30th May, 2009 to the State Government for release of funds
to the University to enable it to release payment to the teachers and other
employees of the college and it is for the State Government to release
funds at the earliest.
Learned counsel for the State, on the other hand, though
does not acknowledge out-rightly the receipt of any such requisition from
the University, but assures that if requisition has been received by the
State Government, he would pursue the matter so that the funds are
released within ten days to the University.
Considering the above submissions, the concerned
authority of the respondent State Government is directed to ensure that the
funds required by the University for payment of arrears of salary to the
teachers of the college under it and also to those under the Ranchi
University, are released within ten days from the date of
receipt/production of a copy of this order and within ten days from the
date of receipt of funds, the respondent University shall ensure
disbursement of the payable amount to the petitioners and the other
teachers.
Let a copy of this order be given to the learned counsel
for the respondent State and the learned counsel for the University.
