WP.(S) No. 4651 OF 2009
----
In the matter of an application under Article 226 of the Constitution of India.

Sunil Singh Badal …… ………….. Petitioner
Vs.
1. The Union of India
2. The Deputy Director General (ER), AIR, Kolkata
3. The Station Director, AIR, Ranchi Respondents
——-
PRESENT
HON’BLE THE CHIEF JUSTICE
HON’BLE MRS.JUSTICE POONAM SRIVASTAV
For the Petitioner JC to Mr. Vishal Kumar Trivedi
For the Respondents Mr. Prabhash Kumar
———
By Court Heard learned counsel for the parties.
2. The case is not pursuaded by the learned counsel for the petitioner in terms
of the High Court Rules and he has not filed Paper Book. On this account alone, the petition
deserves to be dismissed.
3. However, we have examined the order impugned in this petition. The
petition was for challenging the transfer order from Ranchi to Sasaram. Such prayer was
made before the Central Administrative Tribunal. The Central Administrative Tribunal has
not countenanced the challenge because one of the basis was that he was appointed as
Announcer in the language of Nagpuri which is not a correct proposition. The appointment
order clearly states that he was appointed as Announcer Hindi and his appointment was on
contract basis for five years.
4. In that view of the matter, the plea that he was appointed as Nagpuri
exponent is not a correct proposition. Therefore, the transfer order was challenged on the
premises which is not know to law; neither mala fide, nor violation of any law has been
alleged .
5. Thus, we do not see any infirmity in the order of the Central Administrative
Tribunal. Therefore, there is no force in this petition, which is accordingly dismissed.
