1. Pursuant
to notice, the respondent – Mr. A.K. Ansari, Chief Executive Officer
of Wakf Board is present before us. He is represented by learned
advocate Mr. Gandhi.
2. We
have taken into consideration the affidavit-in-reply filed by Mr.
Ansari alongwith annexures thereto.
3. It
appears that after the order making a reference for contempt was
passed, affidavit showing details was filed before the learned Single
Judge on that very day alongwith apology. It also transpires that on
the basis of the material produced, the learned Single Judge has
disposed of the petition on 04th December, 2009. It may
also be noted that before us also, Mr. Ansari has tendered
unconditional apology. In this set of circumstances, we are of the
view that contempt proceedings are not required to be pursued any
further. We, therefore, discharge the notice. The application
stands disposed of.
