Having heard learned counsel for both the

parties and, after considering their

submissions and also the reasons assigned by

the Sessions Judge, Pali, in its order dated

10th June, 2009 while rejecting the application

of the petitioner under Section 438, Cr.P.C., I

am not inclined to allow this application and

the same is accordingly dismissed.
