28. 12.10.2011 On 01.09.2010, undertaking was given by the

respondent that he will not transfer the land without the

permission of the Court till any further order is passed on

the I.A. No.6651 of 2010. Thereafter, in spite of several

adjournments neither any counter-affidavit is filed nor

anybody is appearing on behalf of the respondent. The

interim order is continuing. Today also, when the case is

called out, nobody appeared on behalf of the respondent.

The learned counsel, Mr. Birju Prasad is appearing on

behalf of the appellant.

In view of the above facts, the interim order

dated 01.09.2010 is made absolute.
