2. 07.03.2011. Heard learned counsels for the
petitioner and the State.
The petitioner being the Godown
Manager of Biscomaun is apprehending his
arrest in a case registered under
Sections 420, 467, 468 and 471 of the
I.P.C.
It is alleged that Pacs distributed some loan amount sanctioned to the Co-operative Bank. It is submitted by the learned counsel for the petitioner that the petitioner was not the sanctioning authority and has no concern with
distribution of loan amount. The case was
instituted in 1990 but still
investigation is not complete. The
impugned order reflects that the
petitioner has already retired in 2007.
Considering the fact that investigation is still pending and the
petitioner has already retired, let the

petitioner above named be released on
bail in the event of arrest or surrender
before the learned court below within a
period of twelve weeks from today in
connection with Ishuapur P.S. Case No. 87
of 1992 on furnishing bail bond of Rs.
10,000/-(Ten Thousand)with two sureties
of the like amount each to the
satisfaction of the learned C. J. M.,
Saran at Chapra, subject to the
conditions as laid down under Section
438(2) of the Code of Criminal Procedure.
Learned court below will be at
liberty to cancel the bail bond of the
petitioner if the petitioner fails to
appear on three consecutive dates during
trial.
