Heard learned counsel for the applicant, learned A.G.A. and
perused the entire record of the case.
The submission of learned counsel for the applicant is that, there
are three cases shown against accused applicant in the gang-
chart. In case crime no. 321/04, accused-applicant has been
acquitted, as averred in para 4 of the supplementary affidavit and
in the remaining two cases, accused applicant is on bail, as
averred in para 7 of the bail application. It is further submitted
that this case under U.P. Gangsters and Antisocial Activities
(Prevention) Act has been slapped on the accused-applicant by
the police, in vengeance, so that the accused-applicant may
languish in jail for a considerable long period. The applicant is in
jail since 2.11.2009, as averred in para 11 of the bail application,
which has not been controverted by the State.
Considering the overall aspects of the matter, I hereby provide
that the applicant be released on bail in Case Crime No.1993 of
2009, under Section 2/3 U.P. Gangsters and Antisocial Activities
(Prevention) Act, 1986, P.S.Kotwali Sitapur, District Sitapur, on
his filing a personal bond and two sureties each in the like
amount to the satisfaction of the court concerned.
