Court No. - 47 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 35863 of 2009 Petitioner :- Surendra Respondent :- State Of U.P. Petitioner Counsel :- Prashant K.Lal Respondent Counsel :- Govt Advocate Hon'ble Amar Saran,J.
Sri Rajul Bhargava files appearance slip on behalf of the
applicant.
Heard the learned counsel for the applicant and the learned A.G.A.
for the State.
It is argued by the learned counsel for the applicant that the
similarly placed co-accused Jomdar Singh and Suraj Bhan have
been granted bail by an earlier dated 9.11.2009 passed by Hon’ble
Ravindra Singh, J. There were cross versions and both sides
received injuries.
Per contra, learned A.G.A. could not distinguish the case of the
applicant from the case of the aforesaid co-accused and opposed
the prayer for bail.
Having heard the submissions of the learned counsel for the parties
and without expressing any opinion on the merits of the case, let
the applicant Surendra, involved in Case Crime No. 199/2009,
under sections 147, 148, 149, 307, 302 IPC, Police Station
Kagarol, district Agra, be released on bail on his furnishing a
personal bond with two sureties each in the like amount to the
satisfaction of the Court concerned.
