Rule.

Learned APP Mr.M.G.Nanavati waives service of rule on behalf of the
respondent State.

By
order dated 19.07.2010 passed in Criminal Misc. Application No.7846
of 2010 the application of the present applicant for release of his
passport temporarily on certain conditions was granted. Learned
Sessions Court was to release the passport. In this application, it
is stated that the passport is actually lying with officer in charge
of the Umra Police Station and not with the Sessions Court. The
applicant, therefore, requests for necessary modification in the said
order dated 19.07.2010. Therefore, in continuation of the order dated
19.07.2010, it is provided that the officer in charge of the Umra
Police Station shall release the passport on same terms and
conditions as contained in the order dated 19.07.2010. Subject to
above modification, rest of the order dated 19.07.2010 remains
unchanged.

Rule is made
abosolute to the above extent. Direct Service, today, is permitted.
