                                O R D E R

The petitioner is the second accused, in crime

No.202/2006 of Nooranad Police Station, the offence

alleged against him being under Sections 8(1) & 8(2) and

55(a) of the Abkari Act. It is alleged that the petitioner

was found in illegal possession of 900 liters of spirit on

15.6.2006, transporting in a Tata Sumo car. He was

arrested and remains in judicial custody from that day

onwards. Hence this application under Section 439

Cr.P.C.

2. I heard the arguments advanced by the learned

counsel and the learned Public prosecutor. Considering

that there is no other case registered against the

petitioner and other aspects that are placed before me, I

grant bail and release the petitioner from jail, subject to

the following conditions:-

(a). The petitioner shall execute a bond

for Rs.25,000/-, with two solvent

sureties, each for the like sum, to the

satisfaction of the Judicial Magistrate of

First Class, Mavelikkara.

(b). The petitioner shall report before

the Investigating Officer, once in a week

on every Thursday, between 10.00 a.m

and 11.00 a.m., for a period of four

months, starting from 17.8.2006.

The application is allowed as above.

Hand over the order today itself.
