                                ORDER

Petitioner is accused in C.C.No.305 of 2008 of the court of

learned Chief Judicial Magistrate, Ernakulam for offences

punishable under sections 143, 147, 148, 332, 283 r/w 149 of the

Indian Penal Code and section 3(2)(C) of the PDPP Act. Petitioner

was granted bail on 07-07-2006 but subject to the conditions

including that he will deposit Rs.10,000/- in the court below.

Petitioner executed the bond but did not deposit the amount. He

states that since he was at Calcutta he could not deposit the

amount. Since the bail conditions were not complied learned Chief

Judicial Magistrate canceled the bail. Now the prayer of petitioner

is that direction may be given to the learned Chief Judicial

Magistrate, Ernakulam to dispose of the application for bail he will

be preferring on the same day it is preferred.

2. The request cannot be entertained in the light of the

decision of this court in Martin Vs. State of Kerala (2004(2)

KLT 1037). However considering the facts and circumstances I

direct the learned Chief Judicial Magistrate, Ernakulam to dispose

of the application for bail if any preferred by the petitioner as

expeditiously as possible.

With the above directions this petition is dismissed.
