This petition is for bail.

2. The alleged offences are under Sections 143, 147, 148 and

308 read with 149 of Indian Penal Code. Petitioner is the fourth

accused. He was arrested on 7.7.2008.

3. Learned counsel for petitioner submitted that the name of

the petitioner is not shown in the FIR, but he was subsequently

implicated and arrested. The petitioner is innocent of the

allegations made and his father’s death anniversary falls on

1.8.2008 and petitioner is the only son, who has to do the rituals

on the death anniversary. Petitioner is prepared to abide by any

conditions, it is submitted.

4.Taking into consideration the peculiar facts and

circumstances, learned Public Prosecutor submitted that he has no

objection in granting bail to the petitioner on stringent conditions.

Yet it is submitted that in this case, many accused are involved and

fourth accused alone is arrested and others are still absconding. A

clash between LPF and RSS workers is involved.

5. On hearing both sides, I find that bail can be granted to the

petitioner on conditions. Hence, the following order is passed:

Petitioner is granted bail on his executing a bond for

Rs.25,000/- with two solvent sureties each for the like sum to

the satisfaction of the Magistrate Court concerned on the

following conditions:


    i)     Petitioner shall report before the investigating

           officer  on   every     Monday     and   Thursday

between 10 am and 1 pm until further orders.

ii) Petitioner shall not enter the limits of the police

station within which the crime is registered,

except for the compliance of the direction in

clause-(ii) above and also on 1.8.2008 for

attending the rituals in connection with his

father’s death anniversary.

Iii) Petitioner shall not influence or threaten any

witness or commit any offence or tamper with

evidence while on bail and in case of breach of

this condition, bail is liable to be cancelled.

Petition is allowed.
