Heard learned counsel for the petitioner and Sri Pankaj Srivastava, Advocate
for the respondent Bank.
In present writ petition, the petitioner is questioning the validity of order dated
04.04.2009, whereby communication has been sent informing the petitioner
that he is not entitled for the benefit under the Debts Relief Scheme-2008.
Petitioner’s contention before this Court is that no reason, whatsoever, has
been assigned as to why the petitioner is not entitled to the benefit under the
aforesaid scheme.
Record in question reflects that the petitioner was already informed on
20.08.2009 by letter sent by the Head Quarter as to why the petitioner was not
entitled to the benefit of the aforesaid scheme. Copy of said letter has not been
appended by the petitioner before this Court and the submission is being
raised that in letter dated 04.04.2009 no reason has been assigned.
Once this is the factual scenario that the communication had already been sent
to the petitioner on 20.09.2008 informing him the ground on which he was not
entitled to the benefit under the Debts Relief Scheme-2008, and by order
dated 04.04.2009 mere communication has been sent, as such said order
cannot be assailed for lack of reason.
Consequently, present writ petition, as it has been framed and drawn, is
dismissed.
