Heard learned counsel for the petitioners and learned Additional
Government Advocate.
Although this is a second writ petition, the first writ petition was
dismissed on 17.5.2010, but it is pointed out by the learned
counsel for the petitioner that the deponent Smt. Priti was detained
by her parents and only after a habeas corpus petition was filed,
she appeared before this Court and was allowed to go where she
likes.
Today again Smt. Priti is present in Court and has been identified
by her lawyer. She states that she has married Surjeet voluntarily
and there is no abduction and as per medical certificate and school
leaving certificate, which are annexed with this petition, she is
major her date of birth being 10.10.1988.
In this view of the matter issue notice to respondent No. 4, who
may file a counter affidavit within four weeks. Learned AGA may
also file a counter affidavit within the aforesaid period.
Rejoinder affidavit may be filed within two weeks thereafter.
List thereafter.
Till the next date of listing, the arrest of the petitioners in case
crime No.210 of 2010, under sections 363/366/504/506 IPC, PS
Shahganj, district Agra shall remain stayed.
