The petitioner seeks quashing of the order dated

3.12.2008 whereby she has been declared ineligible for the award of

LPG Distributorship.

While issuing notice of motion, a Division Bench of this

Court vide order dated 18.12.2008 directed the respondents to permit

the petitioner to participate in the selection process, without creating

any equitable and legal right in her favour.

Mr. Kapoor, learned counsel for the respondents submits

that in deference to the aforesaid order, the petitioner’s candidature

has been considered. However, as per the original result, which he

has produced in Court, the petitioner – Surjit Kaur wife of late Baldev

Singh has not been selected and is far below in the order of merit.

Mr. Kapoor, learned counsel for the respondents undertakes to hand-

over a photo copy of the final result to learned counsel for the
petitioner during the course of day.

In this view of the matter, learned counsel for the

petitioner does not press this writ petition and the same is dismissed

as withdrawn, however, with liberty to the petitioner to challenge the

final result, if so advised.
