This application has been filed with a prayer to quash the
proceedings in complaint case No.25181 of 2009, State versus
Shshil Kumar Pandey, under Section 14 of the Employees’
Provident Funds and Miscellaneous Provisions Act, 1952 pending
in the Court of learned Chief Metropolitan Magistrate, Kanpur
Nagar.
Considering the facts and circumstances of the case, it is directed
that in case the applicant moves application along with objection
before the learned C.M.M. Kanpur Nagar in respect of the
provident fund, the same shall be heard and disposed of in
accordance with the law. The application along with objection
shall be filed before the Court concerned within 30 days from
today no coercive steps shall be taken against the applicant till the
disposal of that application.
With this direction the application is finally disposed of.
