ORDER
1. This
application has been filed with a prayer to permit the applicants,
being heirs and legal representatives of the deceased petitioner of
Special Civil Application No.9016 of 1998, to be brought on the
record of the said petition, as petitioners.
2. Heard
Mr. Umang Oza, learned advocate for Mr. B.S. Patel, learned counsel
for the applicants and perused the averments made in the application.
3. It
is stated in the application that Shri Navinchandra Amrutlal Shah,
the petitioner, who filed Special Civil Application No.9016 of 1998,
expired on 18.12.2010. A copy of the Death Certificate is annexed as
Annexure-‘A’ to the petition. Applicant No.1 is the widow of deceased
Navinchandra Amrutlal Shah and applicant No.2 is his son, whereas
applicants Nos.3 and 4 are daughters of the deceased-original
petitioner. It is further stated that except for the above, there are
no other heirs of the deceased petitioner, therefore, the applicants
may be brought on the record of the petition.
4. Heard
the learned advocate for the applicants. In view of the averments
made in the application and as there is no delay in filing the
application, the prayers made therein deserve to be granted.
5. Accordingly,
the application is allowed. The applicants, as described in the
cause-title of the application, are permitted to be brought on the
record of Special Civil Application No.9016 of 1998 as heirs and
legal representatives of deceased Navinchandra Amrutlal Shah, in his
place, as petitioners.
The
necessary amendments in the cause-title of the petition may be
carried out, within a period of one week from today.
6. The
application is disposed of, in the above terms.
