                                 JUDGMENT

The petitioner is aggrieved by the selection to the post of Kazhakam

and Counter Clerk in Cherpulassery Sree Ayyappankavu Devaswom.

According to the petitioner, he is the rightful claimant for the said post, but

has been denied the benefit of appointment without any just cause.

Challenging the same, he has filed Ext.P7 before the first respondent,

Commissioner, Malabar Devaswom Board. It was rejected as per Ext.P8

communication stating that he has not remitted the notice charge and court

fee along with the same. It is submitted that immediately after receipt of

Ext.P8, the petitioner has re-presented the same after curing the defect. But

meanwhile, the 4th respondent has been appointed on temporary basis as

Kazhakam.

2. In the light of the fact that Ext.P7 has been duly re-presented

pursuant to the direction in Ext.P8, the first respondent will have to take

appropriate action on Ext.P7 after hearing all parties including the newly

appointed person. Therefore, there will be a direction to the first respondent

to consider and pass orders on Ext.P7 as expeditiously as possible, with

notice to all parties concerned, within a period of two months from the date

of receipt of a copy of this judgment. The petitioner will be free to file any

petition seeking interim order in the matter.

The writ petition is disposed of as above. No costs.
