ORDER

1. The
present application under Section 5 of the Limitation Act has been
preferred by the applicant-original appellant to condone the delay of
21 days in preferring the Appeal from Order challenging the order
passed by the learned Judge, City Civil Court, Ahmedabad dated
07/02/2011 below Notice of Motion in Civil Suit No. 2433/2008.

2. Heard
Shri Kinariwala, learned advocate appearing on behalf of the
applicant, Shri Dhaval Nanavati, learned advocate appearing on
behalf of opponent no. 1 and Shri Sanjay Mehta, learned advocate
appearing on behalf of opponent no. 2 and
considering the averments made in the application with respect to the
prayer to condone the delay and so
as to give one opportunity to the applicant to submit the case on
merits rather than non suiting it on the technical ground of delay,
the delay caused in preferring the Appeal from Order is hereby
condoned. The present application is allowed. Rule is made absolute
accordingly. No cost.
