JUDGMENT

1. Vide the Stay Order No. S-630 to S-633/CAL/2000 dated 24.5.2000 disposing of four Stay petitions, M/s. Tejas Exports were directed to deposit an amount of Rs.1.00 score (Rupees one crore) within a period of six weeks from the date of receipt of the Order and the other three appellants’ Stay Petitions were allowed unconditionally, dispensing with the condition of predeposit of the penalties imposed upon them.

2. It is seen that one of the appellants, Shri Narain Singh Parekh had filed a Writ Petition before the Honourable High Court against the Stay Order on mis-interpretation of the Order and under the belief that the direction to deposit Rs.1.00 crore is directed towards him. However, Shri N.S.Parekh appearing today makes it clear that no Writ Petition has been filed by M/s. Tejas Exports gainst the above Stay Order and he is in no way concerned with the appeal of M/s. Tejas Exports.

3. Inasmuch as M/s. Tejas Exports have not complied with the Stay Order in spite of the long period having been lapsed, we dismiss the appeal filed by M/s. Tejas Exports. The other three appeals will come up for regular hearing inasmuch as their Stay Petitions were allowed unconditionally by the Tribunal. The other three appeals are foxed for hearing on 21.11.2001.
