1. The
present application is filed seeking temporary bail for a period of
30 days on the occasion of marriage of his three daughters.
2. Heard
learned Advocate Ms.Meenu Kumar for the applicant.
3. RULE.
Mr.Kartik Pandya, learned Additional Public Prosecutor waives
service of Rule on behalf of the respondent-State.
4. Learned
APP invited attention of the Court to the jail remarks. The convict
is undergoing life imprisonment for an offence under Section 302 of
the Indian Penal Code. He is in jail since 07.10.2009. He is
convicted by judgment and order dated 31.03.2010. He has not enjoyed
any leave so far.
5. For
the contents of the application, the application is allowed. The
applicant-convict is ordered to be released on temporary bail for a
period of 30 days from the date of his release in Criminal Appeal
No.1038 of 2010 pending before this Court, on his executing a
personal bond of Rs.5,000/- (Rupees Five Thousand Only) to the
satisfaction of the Jail authorities.
It being the first
release, it is directed that the convict shall mark his presence on
every Monday between 08.00 am to 12.00 pm to the nearest Police
Station.
6. The
applicant shall surrender to the Jail authorities on expiry of the
temporary bail period.
7. Rule is made
absolute.
Direct
service permitted today.
