Subsequent to the order passed to-day in WAMP No.1767 of 2006, the above Appeal is heard by us.

The said Appeal is filed against the order of the learned single Judge, directing the respondent viz., Commissioner, Corporation of Chennai, to dispose of the representation/objection of the petitioners dated 06.11.2003 in the light of the order of the Division Bench made in WA No.764 of 1999 dated 13.04.1999. Though learned counsel appearing for the appellant contended that draft rules are yet to be approved by the Government, we are of the view that it is unnecessary to go into the said aspect since the learned Judge has merely directed the Commissioner to consider and dispose of the representation of the petitioners dated 06.11.2003 in the light of the order of the Division Bench in W.A. No.764 of 1999. In view of the limited direction by the learned Judge, we do not find any valid ground for interference. Consequently, the Writ Appeal is dismissed. No costs.

3. As ordered by the learned Judge, the Commissioner shall consider and dispose of the representation of the petitioners applying the decision of the Division Bench referred to above, if the same is applicable and permissible, and pass appropriate orders within a period of eight weeks from the date of receipt of copy of this order.
