The learned counsel for the review petitioner submits that

even as I was disposing of the appeal , the judgment in which is

sought to be reviewed, another L.A.A.No.799/2005 filed by the

petitioner was pending before this court and that it was without

noticing that aspect that the judgment dated 25.10.2004 was

passed. I notice some merit in the above submission.

Accordingly, I recall my judgment dated 25.10.2004 . Post

the L.A.A. together with the connected case before the

appropriate court.
