                                 JUDGMENT

This appeal by the Government is directed against the

judgment and decree of the Sub Court, Kozhikode in LAR No.530 of

1999. The impugned judgment was not a judgment in isolation, it was

a common judgment in 14 reference cases. Learned Government

Pleader fairly concedes that the Government preferred appeals only in

the present case which corresponds to LAR No.530/99 and against

the judgment in LAR No.434/2000. The appeal which was preferred

against LAR No.434/2000 was registered by this court as LAA

No.599/05. It is conceded that L.A.A.No.599/05 was dismissed by

this court approving the enhancement which was granted by the

reference court relying on Ext.A1 judgment in another case. In view

of the finality attained to the judgments in all other 13 cases, i.e., by

the dismissal of LAA No.599/05 and by the non-filing of appeals in

relation to other 12 cases covered by the impugned common

judgment, the Government cannot aspire for a favourable

consideration of this appeal. The appeal will stand dismissed.
