This appeal was posted on 28.11.2008 and thereafter

on 1.12.2008. On 1.12.2008, the appeal was posted to this date

(15.12.2008). Even today, learned counsel for the appellant

submits that there is no response from the appellant, despite a

registered letter. Counsel seeks further time. We do not think

that we should grant any further time since this matter was being

posted from time to time, and there is no instruction. It is also to

be noted that the appeal is of the year 1998. Therefore, the

appeal is dismissed for default.
