It appears that similar appeals preferred by the State of
Bihar were dismissed by a Division Bench of this Court, vide judgment
and order dated 29th March 2011 in L.P.A.No. 230 of 2011 (State of
Bihar and others Vs. Binay Kumar Singh) and other analogous appeals.
Let this matter go out of our list for being listed before
the Bench which decided L.P.A.No. 230 of 2011 and analogous cases.
Earlier we were told by the counsel for the State in similar matters that
review application has been filed in L.P.A.No. 230 of 2011 and other
analogous cases, If the review applications are still pending, this appeal
may be listed along with the same.
