H.L. Dattu, C.J.:

This appeal arises out of the orders passed by the learned single

Judge in W.P.(C)No. 28279 of 2007 dated 3rd October, 2007.

2. The learned single Judge, while granting the interim prayer, has

faithfully followed the dictum laid down by the Division Bench of this Court in

Malamkara Orthodox Syrian Church Medical College, Kolencherry vs.

Fee Regulatory Committee for Professional Colleges (W.P.(C) No. 16303

of 2007 dated 18th August 2007).

3. In our opinion, since the learned single Judge has followed the

dictum laid down by a Division Bench of this court, it cannot be said that the

learned single Judge has committed any error. In that view of the matter, no

interference is called for. Accordingly, the Writ Appeal requires to be rejected

and it is rejected.

Ordered accordingly.

H.L. DATTU,

CHIEF JUSTICE.

K.T. SANKARAN,

JUDGE.
