The similar controversy involved in this appeal was also involved in First
appeal no. 826 of 1993. The above first appeal arising out of same judgment
and decree dated 3.8.1991 has already been decided, therefore, this appeal is
also covered by the same judgment.

The appeal is dismissed in terms of the judgment dated 10.9.2009 which shall
form part of this judgment also.

The transposition application is rejected.
