                                 JUDGMENT

H.L.Dattu,C.J.

Public spirited citizens and the Residents’ Association are

before this Court in this public interest litigation, inter alia, seeking the

following reliefs. They are as under:

“(i) Call for the records relating to the proposed

covering up of the last reach of Edanada – Killiyar thodu and

peruse the same.

(ii) Issue a Writ of Certiorari quashing Ext.P-5 tender

and all further proceedings pursuant to the same.

(iii) Direct the respondents to consider Ext.P-3 report

of the expert and carry out the recommendations contain

therein.

(iv) Direct the respondents to ensure that water

logging in the residential area of petitioners is effectively

managed by further widening the thodu to ensure efficient

discharge of rainwater into Killiyar river.

(v) Direct the respondents to utilize the funds for

Ext.P-5 work for ensuring greater discharge of storm water and

for Flood management activities in the area.

(vi) To declare that it is not the duty of the respondent

department to construct the road in the area”.

(2) The respondents have filed their detailed counter

affidavit. In that, they have enclosed the earlier orders passed by a Division

Bench of this Court.

(3) Confederation of Consumer Vigilance Centre, represented

by its General Secretary was before this Court in W.P.(C).No.12396 of

2006. The main relief sought in the writ petition was, to direct the

respondents in the writ petition to complete the work of providing concrete

slabs and constructing retaining walls for Edanadu Thodu as expeditiously

as possible.

(4) After service of notice, the 2nd respondent in the writ

petition – Executive Engineer, Minor Irrigation, Thiruvananthapuram – had

filed a statement before this Court, wherein he had stated, that, the work

will be completed within six months from the date of the order.

(5) Placing on record the statement of the 2nd respondent/

Executive Engineer, the writ petition came to be disposed of by this Court.

(6) After the disposal of the aforesaid writ petition, yet

another citizen was before this Court in W.P.(C).No.29072 of 2006. The

prayer made in that writ petition was, that, the drainage should not be

covered with concrete slabs, since it would lead to flooding of the area

during rainy season. The request of the petitioner in the writ petition was

rejected by this Court, by its order dated 20th November, 2006. The

aforesaid order passed by this Court reads as under:-

“In this public interest litigation filed by K.Venugopalan

Nair, the prayer is that the drain should not be covered as that

would lead to flood during rainy season. Learned counsel for the

petitioner has not been able to impress us as to how only

covering of drain which is otherwise required keeping away

hygienic conditions would result into flood during rainy season.

We do not find any merit in this petition. However, we dispose of

this petition by simply observing that while the process of

covering the drainage is done by putting slabs, adequate

precaution should be taken that it would not lead to flood during

rainy season”.

(7) Since the respondents had not complied with the orders

and directions issued by this Court in W.P.(C).No.12396 of 2006, the

Confederation of Consumer Vigilance Centre was before this Court in

Cont.Case (C).No.88 of 2007. The said petition came to be disposed of by

this Court on 22nd January, 2007, placing on record the statement made by

the learned Government Pleader, that, the work will be commenced and

completed within a particular time frame.

(8) After disposal of all these writ petitions and the contempt

petition, now yet another group of residents of the locality are before this

Court in this writ petition, for the reliefs indicated by us earlier.

(9) Having gone through the pleadings made in the writ

petition and the prayers sought therein and also the earlier orders passed by

W.P.(C).No.24692/2008-S – 4 –

this Court, we are of the opinion, that, if, for any reason, we grant the reliefs

sought in the writ petition, it would be literally passing an order contrary to

the earlier orders passed by this Court. In our opinion, the same is

impermissible in law. Therefore, the reliefs sought for by the petitioners in

this writ petition cannot be granted by us, in view of the earlier orders

passed by this Court in the writ petitions and the contempt petition.

(10) Accordingly, the writ petition requires to be rejected and

it is rejected.

(11) In view of the orders passed in the writ petition, all

pending interlocutory applications are rejected.

Ordered accordingly.
