ORDER

1). The
present appellant/original complainant filed Criminal Case No.12477
of 2006 before the Ld. 5th Additional Senior Civil Judge &
JMFC, Surat for the offence punishable U/s. 138 of Negotiable
Instruments Act, wherein the Ld. JMFC, Surat convicted the accused
U/s.138 of Negotiable Instruments Act and sentenced him to undergo
simple imprisonment for one year and pay fine of Rs.5,000/-, in
default, to undergo simple imprisonment for three months.

2). The
accused preferred Criminal Appeal No.49 of 2008 before the Ld. 3rd
Additional District & Sessions Judge, Surat against the order of
Ld. JMFC, Surat, wherein the order of Ld. JMFC was quashed and set
aside, against which order, the original complainant filed the
present appeal before this Court.

3). Heard
Ld. Advocate Mr. Tulsi Savani for the appellant. He produced on
record a letter stating that settlement is arrived at between the
parties and the amount is paid. In view of the settlement arrived at
between the parties, Ld. Advocate appearing for the appellant seeks
permission to withdraw this appeal. Permission as sought for is
granted. The appeal is disposed of as withdrawn.
