Heard learned counsel for the appellant as well as Sri V.P. Pandey holding
brief of Sri H.P. Dubey learned counsel for Electricity Department and
learned AGA in opposition.

The appellant has been convicted in Special Case No.19 of 2007 arising out of
Case Crime No.151 of 2007, under Section 135 (1)-A of Electricity Act,
Police Station Jaswant Nagar, District Etawah and the maximum sentence
awarded to him is two years R.I.
Learned counsel for the appellant contended that the appellant was on bail
during the trial and he has not misused the liberty of bail. He further
contended that the appeal is not likely to be heard in near future.
Learned AGA could not dispute the said fact.
Without expressing any opinion on merit, let the appellant Tilak Singh be
enlarged on bail on his furnishing a personal bond of Rs. one lac with two
sureties each in the like amount to the satisfaction of the trial Judge concerned
in the above sessions trial for above offence. As soon as personal and surety
bonds are furnished, photocopies of the same are directed to be transmitted to
this Court forthwith by trial Judge, to be kept on the record of this appeal.
