ORAL
ORDER

1. After
the matter was disposed of, learned senior advocate Mr. K.M. Patel
with Mr. Dipak R. Dave, mentioned the matter at 2.30 p.m. and stated
that though it was understood yesterday that, an undertaking of
‘transferee’, who is proposed to be joined as party in the suit by
the plaintiff, will be filed, an undertaking is filed by
‘transferor’, who is already a party in the suit.

2. This
is a fit case wherein a notice for contempt is required to be issued.
The Court keeps the matter for that purpose on 26th
October 2010.

3. In
light of the fact that learned advocate Mr. Viral K. Shah has filed
undertaking of ‘transferor’ and not ‘transferee’, interim relief,
as prayed for in the Civil Application, is granted. The Trial Court
is restrained from pronouncing judgment.

4. Registry
is directed to communicate this order telephonically to the learned
Judge. Learned senior advocate Mr. K.M. Patel to intimate to his
counterparts about this order telephonically, who, in turn, request
the Trial Court not to pronounce the judgment till 25th
October 2010.
