These are two applications; one for substitution of the deceased-
respondent no.3 and the other is to condone the delay in filing the
substitution application. Both these applications are supported with
an affidavit.
Sri Sudhansu Narain and Sri Gopal Narain have filed their power
on behalf of the heirs and legal representatives of deceased-
respondent no.3 alongwith impleadment application no.177337 of
2002. Learned counsel for the heirs and legal representatives of the
deceased-respondent no.3 does not oppose this substitution
application since he himself has made an impleadment application
to bring on record the heirs and legal representatives of deceased-
respondent no.3.
The reason given in the affidavit for condonation of delay in filing
the substitution application is sufficient. The delay is condoned.
The condonation of delay application is allowed.
In view of the aforesaid circumstances, the substitution application
is allowed. Let the heirs and legal representatives of deceased-
respondent no.3 as mentioned in para 6 of the affidavit be
substituted in the array of parties. Necessary substitution be carried
out within two weeks.
As a consequence of this order Application No.177337 of 2002
also stands disposed of.
