2 30.03.2011 After having heard learned counsel appearing for

the petitioner and after having considered the order dated

22.09.2010 passed by the Chief Judicial Magistrate, Ara in Trial

No. 1764 of 2010 Chandi P.S. Case No. 51 of 2010, this Court

is not inclined to interfere with the order. However, the

petitioner’s contention is that he is not named in the F.I.R. and in

case vehicle which was seized from his son, it was sold to him

quite earlier to the occurrence. If this be so, then the petitioner

may raise this point at the time of framing of charge and the

Court below shall pass a reasoned order.

With the above observation, this petition is

disposed of.
