04. 03.08.2011 The present L.P.A. arises out of the order

passed in C.W.J.C. No.9221 of 2003 dated 22nd

March, 2007, whereby the learned Single Judge

refused to grant any relief to the appellant herein as

he was compulsory retired when charges have been

proved against him.

As charges have remained proved against

the appellant, we do not inclined to interfere with the

order of the learned Single Judge.

However, as the order of punishment is

passed by way of compulsory retirement, we are of the

opinion that the appellant is entitled of any benefits

which arises out of the compulsory retirement as per

Rules which shall be paid to him as expeditiously as

possible.

With the above observation, the L.P.A.

stands disposed of.
