which is impugned in the present Writ Petition, the respondent no.3 has
already filed a Writ Petition being Civil Misc. Writ Petition No. 60757 of
2009.

Sri Saral Srivastava , learned counsel for the petitioners states that the
respondent no.2 is the proforma respondent , therefore, notice need not be sent
to the respondent no.2.
Notice will be issued to the respondent nos. 1 and 3 fixing 16.2.2010.
Counter affidavit on behalf of the respondent nos. 1 and 3 may be filed
within four weeks.
Rejoinder affidavit may be filed by the next date fixed in the matter.
List this case along with the aforementioned Writ Petition No. 60757 of
2009 on 16.02.2010.
