Learned
advocate Mr. Ashok Patel for Mr. J.D. Ajmera appearing for the
appellant Insurance Company states that there is a cognate appeal,
being First Appeal No.256 of 1985, filed by the claimants which may
be ordered to be placed along with this matter so that both the first
appeals can be heard together.

Besides,
the learned advocate submitted that earlier, learned advocate Mr.
H.B. Shah was representing the claimants in this first appeal as well
as in other first appeal filed by the claimants. According to the
information available with the learned advocate for the appellant-
Insurance Company, learned advocate Mr. P.C. Master was appearing for
Mr. H.B. Shah.

Registry
to find out First Appeal No.256 of 1985 and if the claimants are
represented by a learned advocate in that first appeal then fresh
notice is not required to be issued to the claimants in this first
appeal. Registry to make report on or before 6th
September 2010 and notify this matter along with that First Appeal.
