ORDER

1. Learned
advocate Mr. Y.S. Lakhani appearing on behalf of opponent ?
claimant.

2. This
Court has passed an order on 15th September 1997 which is
quoted as under :

?SRule
returnable on 6.10.1997. Notice as to interim relief. In the
meantime, ad-interim relief in terms of para 5(A) on condition to
deposit Rs.30,000/- with proportionate costs and interest out of
which, as submitted by the learned advocate for the applicant,
Rs.25,000/- have already been deposited before this court. Remaining
amount with proportionate cost and interest shall be paid within four
weeks from today before the Tribunal. The amount of Rs.25,000/-
deposited in this court shall be transmitted to the Tribunal
concerned forthwith. It will be open for the Tribunal to pass
appropriate orders for disbursement and investment in terms of the
impugned award.?S

3. Therefore,
considering the fact that this matter is of the year 1997 and ‘rule’
issued by this Court in light of the disbursement order passed by
this Court and stay was granted on condition to deposit Rs.30,000/-
with cost and proportionate interest. Therefore, now, appeal is to be
heard finally.

4. Accordingly,
rule is made absolute to that extent in this Civil Application.
